Shipping Policy

All deliveries require an adult signature. You must be at least 21 years of age to purchase and receive wine and spirits.

We ship wine to all states except Alabama, Arkansas, Mississippi, South Dakota, Utah, and Vermont. We only ship wine to select zip codes in these states: DE, IL, KY, MA, MI, NJ, OK, RI, TX.

We ship spirits to all states except: AL, AR, IA, LA, ME, MN, MS, MT, SD, UT, VT, WV and WY. We only ship spirits to select zip codes in these states: CO, CT, DE, FL, GA, ID, IL, IN, KS, MA, MI, MO, NC, NJ, NM, OH, OK, RI, SC, TN, TX and WI.

We ship wine accessories to all 50 states.

For standard, non-scheduled delivery, shipping and handling rates will vary. The standard rates for each selection will be reflected in your shopping cart and will update as the cart is updated. We charge you only our actual cost from our shipping service (generally UPS) with no mark-up!

Various states impose limitations on the quantity of alcoholic beverages that may be purchased and brought into their jurisdiction by a purchaser from another state without requiring the purchaser, a seller or shipper to possess certain licenses or permits. Wine Gems does not, as a condition of sale, assume any obligation nor bear any responsibility whatsoever for applying or obtaining any permits or licenses. Therefore, we recommend that you investigate the possibility of such limitations and determine the manner in which alcoholic beverages may be brought into your state from New York, so as to comply with all of your state’s requirements.

Title to, and ownership of, all wine passes from seller to buyer in the state in which the sale occurs, and buyer takes all responsibility for the wine being transported from the state of sale to the buyer’s selected destination. By placing an order, buyer authorizes seller to act on buyer’s behalf in arranging for transportation of the wine at the buyer’s direction. Alternatively, buyer may choose to pick up the wine at seller’s location or make independent delivery arrangements. For orders being shipped outside New York State, title to, and ownership of, all alcoholic beverages passes from Wine Gems to the buyer in New York State. Therefore, New York State sales tax is applied to your order. Seller makes no representation as to the legal rights of anyone to deliver or import any wines, alcoholic beverages or other goods into any state.

UPS shipping policy update March 2026

To further ensure product integrity and compliance, UPS has introduced an updated delivery process for wine shipments. Effective immediately, UPS will make one delivery attempt at the address provided.

If an adult is not available at the time of delivery, the shipment will be securely redirected to a nearby UPS Hold for Pickup location. These locations offer temperature-controlled storage to help maintain the quality of your wine. A UPS driver will leave a door tag with clear pickup instructions, and the package will be held for up to seven calendar days at no additional cost (the package will be sent back to the return address after seven days). If you are in a rural area and the nearest UPS Hold for Pickup location is more than a 10-minute drive, UPS will attempt up to two additional delivery attempts before redirecting the shipment. This ensures added flexibility while still protecting product quality.

For added convenience, any adult (with an ID) whose last name and address match the shipping label may retrieve the package.

This carrier directed policy is designed to enhance delivery security, compliance, and product protection for all wine shipments.
